The Background

Our client Mr. C, and the complainant were involved in a long-term relationship. Despite being in a committed relationship, both parties resided separately, neither had a criminal history, and there were no previous reports of physical violence between the two beforehand. One night, officers responded to a reported domestic dispute and ultimately charged Mr. C with Assault – Spousal and Assault Cause Bodily Harm – Choking, contrary to sections 266 and 267(c) of the Criminal Code of Canada. These allegations arose following a verbal conflict relating to photos of the complainant being posted online by Mr. C. During the initial confrontation, Mr. C was alleged to have grabbed the complainant by her neck, pushed her onto a couch, and later attempted to remove her from the residence with her hair. The injuries noted were limited to minor scratches and irritation, with neither bald spots nor neck bruising observed, and no loss of consciousness reported. Regardless of the seriousness of the allegations, Mr. C cooperated fully with the police, turned himself in promptly, abided by the release conditions imposed upon him, and demonstrated commitment to resolving the matter responsibly.

The Goals

From the outset, Ms. Quelch sought a resolution that would prevent a criminal conviction for Mr. C, allowing him to move forward while avoiding significant future repercussions. The objective was to secure a result that took into account the complexity of the relationship between both parties and Mr. C’s lack of prior offences in order to avoid any consequences that were disproportionate to Mr. C’s personal history.

The Strategy

The defence strategy prioritized negotiating an outcome reflective of the evidence presented within the case. Both medical and police reports noted only minor scratches and redness, with no evidence of prolonged choking, loss of consciousness, or lasting injuries. The complainant was initially hesitant to provide a formal statement, citing her love for Mr. C and acknowledging that she considered the argumentative nature of their relationship as normal. In addition, the fact Mr. C did not have a criminal record and his long-standing relationship with the complainant had shown no previously documented incidents of violence, ultimately strengthened Ms. Quelch’s defence and resulted in a favourable outcome for our client.

The Results

Through the efforts of Ms. Quelch and her productive discussions with the Crown, the matter was resolved by way of a s. 810 peace bond, with no criminal conviction recorded against Mr. C. This result allowed our client to avoid the stigma and lasting consequences associated with a finding of guilt, while still concluding the matter in a way that the Crown also considered appropriate based on the evidence within the case. Mr. C was made aware of this exceptional outcome and expressed great relief. This resolution protected his future, eliminated the need for a trial, and brought an end to an emotional matter without restricting his life opportunities moving forward. Overall, such a favourable conclusion was only achievable through the preparation and dedicated representation provided by Ms. Quelch.
