LEARN MORE →The Background
Our client, Mr. T, was the subject of an investigation in relation to allegations that he had engaged in sexual misconduct with a minor over an approximate two-year period. Following reports from the complainant that indicated repeated inappropriate sexual contact, Mr. T provided a cautioned statement to the police admitting to certain acts, with the complainant also corroborating some aspects of the allegations. The initial charges imposed on Mr. T were severe and included: Sexual Interference (s.151 CC), Sexual Assault (s.271 CC), and Invitation to Sexual Touching (s.152 CC). In light of the gravity of the allegations, this matter demanded careful and strategic defence to ensure any mitigating circumstances were taken into careful consideration. As a lengthy sentence remained a possibility for Mr. T, Ms. Quelch’s expertise was necessary in providing a defence against the threat of potentiallife-altering legal consequences for our client.
The Goals
The primary objective in this matter was to obtain a sentence that was proportionate to the seriousness of the offences, while factoring in the rehabilitative potential for Mr. T and the personal circumstances that influenced the course of his life. Such factors included Mr. T being a first-time offender with significant health issues, his clear expressions of remorse throughout, and the impacts of colonialism on his life as detailed in the pre-sentence and Gladue reports. The overall aim was to secure a result that enabled Mr. T to serve his sentence in the least restrictive custodial setting possible, while still ensuring that public safety remained at the forefront. Defence efforts focused on seeking placement in culturally appropriate facilities, such as a Healing Lodge, and securing the earliest possible parole opportunities for Mr. T.
The Strategy
Ms. Quelch worked diligently and dedicated her efforts to presenting a thorough case for mitigation during the sentencing. The objective was to provide clear evidence regarding our client in order for the Court to develop a complete picture of the factors influencing his conduct and behaviour during that specific period of time. Ms. Quelch, recognizing the potential for culturally appropriate settings, stressed the use of facilities such as healing lodges and the possibility of early parole as a means to demonstrate that punitive measures can, in fact, be taken while still supporting Mr. T’s own personal needs.
The Results
In the end, the strength of the defence strategy was evident throughout the duration of the trial, specifically during Ms. Quelch’s cross-examination of the complainant. The presiding Judge concluded that the complainant was not credible and therefore acquitted Mr. S of all charges. To the Judge, it was apparent that the burden of proof had not been met, and the defence was subsequently advised that no evidence or submissions were required on their end. Ms. Quelch’s diligent work throughout the cross-examination process resulted in the determination that the complainant’s testimony could not support a criminal conviction. Overall, following a one-day, seven-hour trial, Mr. was found not guilty. This exceptional result for our client can be attributed to the committed and effective representation provided by Ms. Quelch.
