The Background

My client, Mr. B, was charged with two counts of sexual assault and one count of assault. The allegations stemmed from a night when he was at work and the complainant, a co-worker, accused him of assaulting her. There were a few witnesses (fellow employees) who provided statements to the police about the incident.

The Goals

To have the charges withdrawn without a trial.

The Strategy

I had a detailed disclosure review meeting with my client and collected all the important information. Mr. B indicated to me that the complainant consented to the acts he was accused of. I advised him to send me some screenshots of the correspondence he had with the alleged victim.

After collecting and examining all the pieces of evidence provided by my client, I had a counsel pre-trial with the assigned Crown. In this meeting, I advocated that sexual encounter between the accused person and the complainant was consensual. The required evidence corroborating Mr. B’s version of the incident was sent to the Crown. The Crown had a meeting with this alleged victim and discussed the evidence provided by defence.

The Results

The charges against my client were withdrawn by the Crown.
