Rules for Search and Seizure

The Charter of Rights and Freedoms under section 8 gives you the right against arbitrary search and seizure, and your vehicle would be a place where you have a privacy interest.

The circumstances of the search is everything. Depending on the circumstances, depending on what I see in the disclosure, I would then be able to tell you whether there’s a, you know, some chance, a good chance, a strong chance, whatever it might be, it’s going to come from the disclosure, at least my initial assessment and at that point in time I can tell you whether you have a recourse to the Charter of Rights and Freedoms.
