The Background

Mr. R was in his last year of high-school and in the midst of applying to university when he was charged with severe criminal offences by two young complainants who resided in the UK. The allegations were that our client coerced the complainants into sending sexually explicit materials in the form of photographs and videos through social media apps. Furthermore, it was alleged that Mr. R threatened to disseminate the materials that were already in his possession if the complainants would not provide more sexually explicit photographs. The two young females provided police statements which collaborated each of the complainant’s version of events including the threatening nature of Mr. R’s demands for nude materials as well as the form of social media platforms that were used to communicate with both young females.

The Goals

Mr. R was a young man who was facing very severe criminal allegations which could have long lasting effects on his future including educational and career prospects. The goal was to keep our client out of custody and resolve his matter in a way that would have the least negative consequences on his future.

The Strategy

Due to the nature of the allegations as well as our client’s young age, the matter demanded much attention and preparation for sentencing. As such, our direction was to have Mr. R complete a pre-sentence report, private counselling as well as a specialized psychological assessment. Additionally. Mr. R was directed to obtain materials supportive of his character and educational plans.

The Results

It took many months for us to combine all necessary materials to proceed with a carefully structured sentencing plan. However, the result was a success. Although the Crown Attorney called for a six-month jail sentence, we were able to secure a conditional sentence and probation for Mr. R which allowed him to remain in the community and continue pursuing his university education.
