Case Study: Mischief to Data Under $5,000
After a dispute with her employer, the client was charged with “Mischief to Data” contrary to section 430(1.1) of the Criminal Code. The employer alleged that the client intentionally defaced the employer’s website prior to quitting.
The Crown reserved its position pending further investigation.
Ms. H was a working professional and worried that a criminal record would adversely affect her employment and draw the attention of her regulatory (professional) body.
After negotiations with the Crown, Mr. Lemaire was able to convince the Crown that they could simply not prove the allegations against the client. In exchange for a small charitable donation, the charges were withdrawn and the client was able to avoid a criminal record and keep her job.
