The Background

Mr. B had a long criminal record as well as a complicated history coupled with years of struggling with mental health. Additionally, Mr. B was previously convicted of the same and similar offences to which he was currently facing.

The allegations consisted of Mr. B attending a private parking lot where he removed some of his clothing and began to masturbate while looking out on the street. Surveillance cameras captured Mr. B in the act after which he was politely asked to remove himself from the property by the city staff. Mr. B got dressed and after seemingly having left, the returned to the parking lot yet again, this time removed all his clothing, and began to masturbate again. Police was called who located the accused nude, still masturbating.

The Goals

The goal in this case was to keep Mr. B in the community where he could access resources and support given his history and mental health. 

The Strategy

The strategy in this case was to have our client mitigate his situation by completing upfront work such as alcohol and mental health counselling before taking steps to resolve his matter and have discussions with the Crown.

The Results

After a thorough discussion with the Crown Attorney where a fulsome picture of Mr. B was presented as well as after having Mr. B complete some upfront counselling and obtaining further information regarding Mr. B from his mother, the Crown Attorney agreed to have Mr. B enter into a peace bond and have the charge withdrawn.
