LEARN MORE →The Background
Our client, Mr. S, became the focus of an Ontario Provincial Police (OPP) investigation following allegations made against him by a young complainant. According to her, she met Mr. S for the first time at a convenience store, who identified himself by using a false name and age. Mr. S was said to have requested the complainant’s phone number and offered to give her a ride. It was alleged that during the drive, Mr. S directed inappropriate remarks toward her, commented on her clothing, and tried to persuade the complainant to spend more time together. Mr. S was also alleged to have contacted her through an online platform as a means to meet again in the coming weeks.
The complainant later reported observing Mr. S once again in the weeks that followed. Police identified a vehicle that matched the complainant’s description, and initiated a traffic stop, and proceeded to arrest Mr. S and charged him with Invitation to Sexual Touching and Child Luring, contrary to sections 152 and 172.1(1)(b) of the Criminal Code of Canada. Given the serious nature of the allegations, along with the complainant’s age and the penalties associated with such charges, this case relied on Ms. Quelch’s careful preparation and experience to ensure the focus remained on the objective evidence apparent within the case.
The Goals
Ms. Quelch was determined to obtain a full acquittal of all charges for Mr. S. The accusations were serious, and the potential consequences of a criminal conviction were profound for our client. Despite this, Ms. Quelch understood from the outset that this case raised significant credibility concerns that needed to be addressed with accuracy and detail. In the end, the objective was clear: Ms. Quelch sought to secure an acquittal by establishing that the complainant’s evidence would not withstand careful examination from the defence. The priority remained to highlight such weaknesses at trial in a precise and structured manner that left the Court with no dependable basis on which to convict our client, Mr. S.
The Strategy
Throughout the course of this case, Ms. Quelch remained deeply committed to securing the best possible outcome for Mr. S and ensured regular contact with him at all stages. The defence strategy sought to emphasize the inconsistencies in the statements offered by the complainant regarding what truly occurred between both parties during the alleged incidents. Having identified several glaring weaknesses, Ms. Quelch focused primarily on a well-constructed and strategic cross-examination of the complainant. In this context, the objective was to allow the gaps and contradictions in the complainant’s statements to emerge on their own and clearly demonstrate how her recollection, and ultimately her credibility, were significantly compromised.
The Results
In the end, the strength of the defence strategy was evident throughout the duration of the trial, specifically during Ms. Quelch’s cross-examination of the complainant. The presiding Judge concluded that the complainant was not credible and therefore acquitted Mr. S of all charges. To the Judge, it was apparent that the burden of proof had not been met, and the defence was subsequently advised that no evidence or submissions were required on their end. Ms. Quelch’s diligent work throughout the cross-examination process resulted in the determination that the complainant’s testimony could not support a criminal conviction. Overall, following a one-day, seven-hour trial, Mr. S was found not guilty. This exceptional result for our client can be attributed to the committed and effective representation provided by Ms. Quelch.
