What are the various penalties one could receive for criminal harassment? This is an excellent question because there are no mandatory minimum penalties for criminal harassment. As a result the penalties one is in jeopardy of receiving if charged with criminal harassment would depend upon the individual’s own circumstances as well as the degree of the harassment. If an individual has no criminal record and no prior history of such behaviour and the harassment is minimal, there should be no reason why the matter can’t be resolved without the acquisition of a criminal record. If the individual has a history of such behaviour or there is history between the complainant and the accused individual, or if the harassment is of a high degree of culpability, then we can see various punishments from the acquisition of a criminal record, to even periods of incarceration.
